These Terms of Service ("Terms") govern your access to and use of the Social Mobility Project platform and related services operated by Blue Commons Inc. ("we," "our," or "us").

By accessing or using the platform, you agree to these Terms.

If you do not agree to these Terms, you may not use the platform.

1. About the Service

Social Mobility Project provides structured educational and career support services for students, mentors, partner organizations, and related participants.

The platform may include:

  • mentorship programs
  • university and scholarship preparation
  • interview preparation
  • career readiness support
  • messaging and collaboration tools
  • session tracking and progress management
  • educational resources and program materials

2. Eligibility

You must be at least 15 years old to use the platform.

Users under 18 years old may participate only with consent from:

  • a parent or legal guardian, or
  • an authorized supporting organization

By registering or participating, you confirm that you meet these eligibility requirements.

3. User Accounts

To access certain features, users may be required to create an account.

Users agree to:

  • provide accurate information
  • maintain the security of their account
  • keep login credentials confidential
  • use their real identity
  • promptly notify us of unauthorized account access

You are responsible for activities conducted through your account.

We reserve the right to suspend or terminate accounts that violate these Terms or related policies.

4. Program Participation

Participation in the program does not guarantee:

  • university admission
  • scholarship awards
  • internships
  • employment opportunities
  • specific educational or career outcomes

The platform provides structured support and guidance only.

Success depends on many external factors, including student effort, institutional decisions, market conditions, and personal circumstances.

5. Acceptable Use

Users must use the platform respectfully and lawfully.

Users must not:

  • harass or abuse others
  • impersonate another person
  • share false or misleading information
  • attempt unauthorized access to systems or accounts
  • upload malicious software or harmful content
  • violate safeguarding or communication policies
  • use the platform for commercial solicitation
  • share inappropriate or unlawful content

We may remove content or restrict access where necessary to maintain safety and platform integrity.

6. Communication Rules

Mentor-student communication must occur only through approved channels.

Private communication outside approved systems is prohibited.

Approved communication methods may include:

  • the official platform
  • Zoom
  • Google Meet

The following are prohibited for mentor-student communication:

  • LINE
  • WhatsApp
  • Discord
  • Instagram
  • Facebook
  • personal email
  • personal phone or text communication

Additional rules are described in the Safeguarding Policy and Mentor Code of Conduct.

7. Safeguarding and Conduct

All users must comply with:

  • the Safeguarding Policy
  • the Mentor Code of Conduct
  • applicable program rules and guidelines

Violations may result in:

  • warnings
  • account suspension
  • removal from the platform
  • termination of participation
  • reporting to relevant authorities where appropriate

Student safety and wellbeing take priority.

8. Intellectual Property

Unless otherwise stated, platform materials, content, frameworks, templates, and program methodologies are owned by Blue Commons Inc.

Users may not:

  • reproduce
  • distribute
  • resell
  • publicly share
  • modify for commercial use

without prior written permission.

Users retain ownership of materials they personally create and upload, such as essays or application drafts.

By uploading materials, users grant us a limited right to use those materials for program operation, mentoring support, and platform functionality.

9. Data and Privacy

Our collection and use of personal information are governed by our Privacy Policy.

By using the platform, you acknowledge that:

  • session notes and program records may be maintained
  • administrators may review platform activity for operational and safeguarding purposes
  • certain information may be shared with authorized mentors or partner organizations where necessary for program delivery

We do not sell personal information.

10. Platform Availability

We aim to maintain reliable access to the platform but do not guarantee uninterrupted service.

We may:

  • modify features
  • suspend services
  • perform maintenance
  • update or discontinue parts of the platform

without prior notice.

11. Third-Party Services

The platform may rely on third-party services such as:

  • hosting providers
  • authentication services
  • video conferencing tools

We are not responsible for the operation or policies of third-party services.

Users may also be subject to the terms and policies of those providers.

12. Disclaimers

The platform and services are provided on an "as is" and "as available" basis.

We do not guarantee:

  • admission outcomes
  • scholarship results
  • career placement
  • uninterrupted availability
  • error-free operation

We are not licensed providers of:

  • legal services
  • immigration advice
  • psychological treatment
  • medical services

Program participation should not be considered a substitute for professional legal, medical, or mental health support.

13. Limitation of Liability

To the maximum extent permitted by law, Blue Commons Inc. shall not be liable for:

  • indirect or consequential damages
  • loss of opportunities
  • educational or employment decisions made by third parties
  • user conduct
  • technical interruptions
  • unauthorized access beyond reasonable control

Nothing in these Terms limits rights that cannot legally be limited under applicable law.

14. Termination

We may suspend or terminate access to the platform where:

  • these Terms are violated
  • safeguarding concerns arise
  • misuse occurs
  • continued participation is deemed unsafe or inappropriate

Users may also stop using the platform at any time.

Certain obligations, including confidentiality and safeguarding responsibilities, continue after termination.

15. Changes to These Terms

We may update these Terms from time to time.

Updated versions will be posted on the website with a revised effective date.

Continued use of the platform after updates constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of Japan.

Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Japan.
